Public Notice No. 5611

The  County Commissioners’ meeting was called to order on March 16, 2021, at 9:00 a.m. with Chairman Patrick H. Wade, Vice-Chairman John Midkiff, Commissioner Elaine Griffith, and County Clerk Becky L. Freeman present.
Chairman Wade led the Pledge of Allegiance.  
Notice to Proceed- Vice-Chairman Midkiff moved to sign the Notice to Proceed with Timberline for the 2020 Winter Road Rehabilitation Project. Commissioner Griffith seconded and the motion carried.
Diesel Fuel Bid- Commissioner Griffith moved to approve the bid from Westco for Ruby Red diesel fuel at $2.479 per gallon.  Vice-Chairman Midkiff seconded, motion carried.  This price is in effect from March 1, 2021 through December 31, 2021.
Emergency Management- Emergency Management Coordinator James Santistevan met with the Commissioners to discuss the old generator at the fairgrounds.  According to H & H Electric, the generator isn’t large enough to run the courthouse.  He presented a quote from H & H Electric for a 100KW, 120/208V, 3-Phase, Natural Gas Generator with a cold-weather package, automatic transfer switch, concrete mounting pad, and installation for $56,432.50.  Mr. Santistevan said he is applying for a State Homeland Security Grant which would cover the cost if approved.  
County Attorney- County Attorney Anne Wasserburger met with the Commissioners and discussed county business.  She presented a lease agreement for Lusk State Bank to rent space in the old jail for storage of their skid steer.  She will forward the agreement to the Lusk State Bank board of directors for review and signature.    
The group also discussed the lawsuit which was brought against the governor, attorney general, and county health officers regarding State health orders.  Attorney Wasserburger asked to have Niobrara County dismissed from the lawsuit.    
Consent Agenda- Commissioner Griffith, moved to approve the consent agenda.  Vice-Chairman Midkiff seconded, motion carried.  Items on the consent agenda were the minutes of the March 2, 2021 meeting.  
There being no further business, the meeting adjourned.
