NOTICE OF PUBLICATION OF SUMMONS AND NOTICE OF HEARING

TO:    Each of the Above-Named Defendants and Claimants

You are notified that on July 31, 2019, Plaintiffs Joel David Wasserburger, Henry Louis Wasserburger III, Jolene J. Staskal, William Jeffery Wasserburger, Thomas Lee Wasserburger, and Henry L. Wasserburger, Jr., as successor Trustee of the Lorraine O. Wasserburger Trust, dated April 3, 1997 (hereinafter referred to as “Plaintiffs”) filed its Petition for Quiet Title and Declaratory Judgment (hereinafter the “Petition”) in the District Court of the Eighth Judicial District, Niobrara County Wyoming, being Civil Action No. 2019-651. The object and prayer of the Petition in this matter is for the recovery of interest in, certain real property (royalty interests) situate in Niobrara County, Wyoming, more particularly as a twelve and one-half percent (12.5%) mineral royalty interest in an undivided one hundred and sixty (160) mineral acres in the following:

Township 37 North, Range 63 West, 6th P.M.
Section 11:  SE¼SW¼, SW¼SE¼
Section 14:  W½NE¼, E½NW¼, NE¼SW¼, NW¼SE¼
Containing 320 gross mineral acres, more or less.

You are hereby summoned to serve upon the Plaintiff an Answer to the Petition within thirty (30) days after the last day of publication of this notice. Should you fail to file an Answer, the allegations of such Petition shall be taken as true, and the relief sought, including the declaratory judgment and the quieting of title in and to the real property (mineral royalty interests) situate in Niobrara County, Wyoming, will be granted and judgment entered against you.

Notice is also hereby given to the above identified Defendants, including creditors of any of the above-named Defendants, their heirs and devisees, that following the publication period, the Court will hear Plaintiff’s Petition in the District Courtroom of the Eighth Judicial District of Niobrara County, Wyoming.

The named defendants are Keystone Oil Company and W. R. Kohl, whose addresses are unknown at this time.
