NIOBRARA COUNTY COMMISSIONERS’ MEETING NIOBRARA COUNTY, WYOMING
DECEMBER 15, 2020

The County Commissioners’ meeting was called to order December 15, 2020 at 9:00 a.m. with Chairman Patrick H. Wade, Vice-Chairman John Midkiff, Commissioner Elaine Griffith, and County Clerk Becky L. Freeman present.
Chairman Wade led the group in the Pledge of Allegiance.
Chairman Wade called a public hearing to order to receive public comments on two change of zoning applications.
Those in attendance were James Kruse, Jim Kruse, and Lorrie Reed, landowners, Sandra Richardson, and Randy Starkey, Change of Zoning Applicants, Paul Siebke with VistaBeam, and Anne Wasserburger, County Attorney.
Chairman Wade asked for any input from the audience and Jim Kruse inquired about setbacks from the property line. He thought it would be appropriate to have it as a part of the change of zoning requirements. He also inquired about lights on the tower and Mr. Siebke said they were not required under 200’ and this tower will be a 150’ self supporting tower. Mrs. Richardson stated that they are leaving the existing tower in place for citizen band radio users.
According to the change of zoning rules, the County regulations are a 30’ setback. Mr. Kruse said as long as there was a setback and no blinking lights, they didn’t have any objections.
The next change of zoning application to be heard was for Randy and Cynthia Starkey. They wanted to change zoning on two (2) ten (10) acre parcels from agriculture to residential and leave 80 acres as agriculture.

Attorney Wasserburger asked if this division was going to be a subdivision and if they intended to sell the property soon. Mr. Starkey said that they don’t have plans to sell in the immediate future and were not planning on creating a subdivision. Attorney Wasserburger stated that this wouldn’t qualify as a subdivision, simply a change of zoning. She noted that you can’t have mixed classifications if a subdivision is being created.
Chairman Wade asked Lorrie Reed if she had any questions and she did not.
There being no further comments, Chairman Wade closed the hearing and reconvened the regular meeting.
County Attorney Wasserburger had nothing new to report.
Road & Bridge- Foreman Fred Thomas met with the Commissioners and discussed road and bridge business.
He discussed the new road project and said that the bid opening date had been changed to January 5, 2020 at 10:00 a.m.
He said that the engineers approved use of rock from the Fischer Pit for this project. He said that by using this pit, the project mileage can be reduced by approximately 40 miles.
There was nothing to report under old business.
Canon Copier Full Service Agreement - Commissioner Griffith moved to sign the full-service agreement for the Canon copier located in the courthouse. Vice-Chairman Midkiff seconded, motion carried.
Amended and Restated Joint Powers Agreement for the Wyoming Association of Risk Management (W.A.R.M.)- Vice-Chairman Midkiff moved to approve and sign the amended and restated agreement for the W.A.R.M Joint Powers Board. Commissioner Griffith seconded, motion carried.
Vice-Chairman Midkiff moved to ratify the signing of a letter to Governor Gordon dated December 10, 2020, regarding the Statewide Public Health Order #18. Commissioner Griffith seconded, motion carried.
The Commissioners discussed potential action to be taken if a favorable response from the Governor and Dr. Harrist pertaining to the above letter is not received by December 18, 2020.     Commissioner Griffith moved, that in the event of no or an unfavorable response, an official request will be sent to Governor Gordon and Dr. Harrist for a waiver to the Statewide Health Order #18. Vice-Chairman Midkiff seconded, motion carried.
Commissioner Griffith moved, that if the waiver is granted, the Commissioners submit an official statement explaining their position on this waiver. Vice-Chairman Midkiff seconded, motion carried.
Jackie Bredthauer with the Chamber of Commerce met with the Commissioners and Treasurer Keri Thompson to discuss the statewide lodging tax which goes into effect on January 1, 2021.
Change of Zoning- Vice-Chairman Midkiff moved to approve the change of zoning for Randy and Cynthia Starkey from agriculture to two (2) ten (10) acre residential parcels and keep 80 acres as agricultural. Commissioner Griffith seconded, motion carried
Vice-Chairman Midkiff moved to approve the change of zoning for Inventive Wireless d/b/a Vista Beam on property owned by Sandra Richardson from agricultural to commercial with the requirement of a 30’ setback. Commissioner Griffith seconded, motion carried.
Consent Agenda- Commissioner Griffith moved to approve the consent agenda. Vice-Chairman Midkiff seconded, motion carried. Items on the consent agenda were the minutes of the December 1, 2020 meeting. Vice-Chairman Midkiff seconded, motion carried.
Commissioner Griffith moved to sign the reimbursement agreement with the State Lands and Investments Board. Vice-Chairman Midkiff seconded, motion carried.
There being no further business, the meeting adjourned.
