The Third and Final Reading of the following ordinances have been read at the Tuesday, January 6th regular council meeting. Every ordinance shall become effective once published at least once in a newspaper of general circulation.
ORDINANCE NO. 9-5-400
AN ORDINANCE AMENDING EXISTING ORDINANCE 9-5-400 AT PARAGRAPH A TO REQUIRE ANY PERSON OWNING, KEEPING POSSESSING, OR HARBORING A DOG OR CAT TO REMOVE AND DISPOSE ALL FECES LEFT BY SAID ANIMAL(S) ON PUBLIC PROPERTY AND/OR PRIVATE PROPERTY OWNED BY OTHERS AND DECLARING A NUISANCE FOR DOG, CAT, OR OTHER ANIMAL FECES ON THE PROPERTY OF THE OWNER WHICH EMANATES AN OFFENSIVE ODOR, EXCESSIVE FLIES OR OTHER INSECTS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LUSK, WYOMING:
A. Any person owning, keeping, possessing, or harboring a dog or cat shall immediately remove and dispose of, in a sanitary manner, all feces left by said animal(s) whether on public property and/or on private property which is owned by others. Dog, Cat, or other Animal Feces on the property of the owner of said animal that emanates a sustained offensive odor, excessive flies or other insects to neighboring properties shall constitute a nuisance.
ORDINANCE NO. 5-20-150

AN ORDINANCE AMENDING ORDINANCE 5-20-150 AT SECTION FIVE TO CLARIFY PERSONS, FIRMS, OR CORPORATIONS TO WHOM NOTICE SHOULD BE GIVEN REGARDING JUNK ON PROPERTY; AND BY ADDING A SECTION TEN ENTITLED "COSTS AND RECOVERY OF COSTS IF ABATEMENT IS PERFORMED BY THE TOWN."
5-20-150. Section Five. A. When a property is identified as a public nuisance by the Mayor, Town Council, Public Works Director or Law Enforcement Officer of the Town of Lusk, the Lusk Police Department shall attempt to give notice to the person in custody, control and/or occupancy of the property, whether that be the owner, lessee, tenant, occupant, agent of the owner, or personal representative of the owner if deceased. Notice shall be completed by personal service or by certified mail.

A statement that if the nuisance is not abated within the ten day period a criminal misdemeanor charge may be filed which could result in a fine not to exceed $750.00 plus court costs; and a statement that the Town may abate the nuisance the cost of which, as described in Section Ten below, will be charged to the person in custody, control and/or occupancy of the property and could be assessed against the property.

5-20-150. Section Ten. A. In the event the person in custody, control, and/or occupancy of the subject property fails or refuses to abate the nuisance as required by this ordinance, the Town may abate the nuisance either by Town personnel and equipment or by private contractor. The cost of such abatement shall be assessed at $150.00 per hour for labor (whether one or more laborers) and machine costs at the hourly rate customarily charged in industry for use of such machine.
B. If the person determined to be in custody, control and/or in occupancy of the premises does not pay the invoice within 30 days the same shall be charged against the utility charges attendant to the premises as garbage pickup fees. In the event the charges exceed the sum of $500.00 the same may be pro-rated in 12 equal monthly amounts on the monthly utility bill attendant to the premises. In the event the person determined to be in custody, control and/or occupancy of the premises should abandon the premises the balance due shall be included in that person's final utility bill.
Upon final passage of these amended Ordinances the paragraph above shall be inserted in the “Lusk Municipal Code” accordingly.
