PUBLIC NOTICE

The Third and Final Reading of the following ordinance has been read on Tuesday, February 3rd, 2026 regular council meeting. Every ordinance shall become effective once published at least once in a newspaper of general circulation.

ORDINANCE NO. 5-20-160
AN ORDINANCE PROHIBITING OFFENSIVE ODORS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF LUSK, WYOMING:

5-20-160: Offensive Odors A Public Nuisance.
a) It is unlawful for any owner, owner's agent or employee, occupant or occupant's agent of any lot or building within the Town of Lusk to commit, cause, create, permit keep or otherwise maintain any unreasonable noxious, unpleasant or strong odor which causes material distress, discomfort or injury to persons of ordinary sensibilities and which extends beyond the boundaries of the property on which said odor originates. Any such odor is declared to be a nuisance, is prohibited and made unlawful.
b) The following shall constitute offensive odors and health and sanitation nuisances for the purposes of this Ordnance but shall not be deemed exclusive:
1) Chemicals. Offensive odors from the use or possession of chemicals or from industrial processes or activities which shall disturb the comfort and repose of persons of ordinary sensibilities.
2) Smoke. Offensive odors from smoke from the burning of rubbish, trash, garbage, rubber, chemicals, or other substances which shall disturb the comfort and repose of persons of ordinary sensibilities.
3) Stagnant pools, refuse and composting. Offensive odors from stagnant pools, rotting garbage, refuse, or composting which shall disturb the comfort and repose of persons of ordinary sensibilities.
4) Dead animals. Offensive odors from dead animals or offal which shall disturb the comfort and repose of persons with ordinary sensibilities.
c) Any person found guilty of violating any of the provisions of this ordinance shall, upon conviction, be subject to the penalties provided in§ 2-35-100 Lusk Municipal Code, i.e. a fine not to exceed $750.00, applicable court costs for municipal courts and costs of remediation. Each day in which any violation of this Ordinance occurs shall constitute a separate offense.
